A Hatfield man who had sex with a woman without telling her he was HIV positive is to be tagged for the next six months after breaching a sexual risk order.

Tapiwanashe Sibanda, of Richards Street, appeared at St Albans Crown Court on Thursday and pleaded guilty to two charges of breaching the order.

The 24-year-old dustman, who works in St Albans, had a sexual risk order made against him in November 2021, and was banned from becoming involved with women without telling the public protection officers attached to his case.

But, in May 2022, he was in contact with two women and had protected sex with one of them.

While he was on bail for that offence in February this year, he breached the order again by using private settings on his iPhone to stop his call and browsing history being recorded.

"He is incredibly remorseful and understand the impact of his actions. It was naivety, stupidity and poor thinking," said Caroline Skeet, defending.

Judge Caroline Wigin passed down an 18-month sentence suspended for two years, while Sibanda will be put on GPS trail monitoring for the next six months and must attend 30 rehabilitation days.

"If ever there is a case for GPS trail monitoring, this is it," said Judge Wigin.

"There was a blatant disregard of court orders and the safety of others. I don’t trust him."
